Up till now, a comprehensive and systematic argumentation theoretical study of dissociation does not exist. This book aims to fill this gap. Fundamentals of Legal Argumentation: This book is an updated and revised edition of Fundamentals of Legal Argumentation published in It discusses new developments that have taken place in the past 15 years in research of legal argumentation, legal justification and legal interpretation, as well as the implications of these new developments for the theory of legal argumentation.

Almost every chapter has been revised and updated, and the chapters include discussions of recent studies, major additions on topical issues, new perspectives, and new developments in several theoretical areas. Examples of these additions are discussions of recent developments in such areas as Habermas' theory, MacCormick's theory, Alexy's theory, Artificial Intelligence and law, and the pragma-dialectical theory of legal argumentation. Furthermore it provides an extensive and systematic overview of approaches and studies of legal argumentation in the context of legal justification in various legal systems and countries that have been important for the development of research of legal argumentation.

Since the late s the study of argumentation has developed from a marginal part of logic and rhetoric into a genuine interdisciplinary academic discipline. After having first been primarily concerned with creating an adequate philosophical perspective on argumentation, argumentation theorists have gradually shifted their focus of attention to a more immediate concern with the ins and outs of argumentative praxis.

How is the discourse influenced by institutional and contextual constraints? In what way can prominent cases of argumentative discourse be fruitfully analysed?

Argumentation in Practice aims to provide insight into some important facets of argumentative praxis and the different ways in which it can be approached. What links church organs to organised crime, California to the Caliphate, or brackets to codpieces? The Etymologicon springs from Mark Forsyth's Inky Fool blog on the strange connections between words.

Although the list of theoretical issues discussed in these essays is by no means comprehensive, the issues that are treated are certainly representative of the kind of problems the international community of argumentation scholars is pondering on at the moment. Characteristically, this international community includes scholars from different academic backgrounds, varying from classicists, philosophers, and linguists to logicians, and social scientists. These scholars favour different approaches to argumentation, varying from formal and dialectical approaches to informal and rhetorical pragmatic approaches.

Because most of the perspectives on argumentation that are en vogue are represented, this volume provides a multidisciplinary — and as far as different approaches are combined even interdisciplinary — outlook on the current state of affairs in argumentation theory. More by Frans H. Strategic Maneuvering in Argumentative Discourse: Extending the pragma-dialectical theory of argumentation. It takes place in all stages of argumentative discourse and manifests itself simultaneously in the choices that are made from the topical potential available at a particular stage, in adaptation to audience demand, and in the use of specific presentational devices.

Strategic maneuvering derails when in the specific context in which the discourse takes place a rule for critical discussion has been violated, so that a fallacy has been committed. Van Eemeren makes clear that extending the pragma-dialectical approach to argumentation by taking account of strategic maneuvering leads to a richer and more precise method for analyzing and evaluating argumentative discourse. Exploring the relationship between argumentative discourse and institutional context. Prototypical Argumentative Patterns reports about a research project started at the University of Amsterdam in In this project distinctive argumentative patterns have been identified in argumentative discourse in the political, the legal and the medical domain.

These patterns consist of constellations of argumentative moves in which, in order to deal with a particular kind of difference of opinion, in defence of a particular type of standpoint, a particular argument scheme or combination of argument schemes is used in a particular kind of argumentation structure.

The composition of these prototypical argumentative patterns can be explained by referring to the institutional characteristics of the communicative activity types in which they occur. By exploring the relationship between argumentative discourse and the institutional context, Frans van Eemeren, Bart Garssen, Corina Andone, Eveline Feteris and Francisca Snoeck Henkemans have provided a new and illuminating perspective on the context-dependency of argumentative discourse.
